Article 97: Tenure of office of judges

Without prejudice to the provisions of this article, a judge of the Superior Courts shall vacate his office upon reaching the age of sixty-five (65) years: Provided that a judge of the Superior Courts shall inform the Chief Justice and the President of Malta of this decision before he reaches the age of sixty-five (65) years once he chooses to remain in office until he reaches the age of sixty-eight (68) years.

A judge of the superior courts shall not be removed from his office except as provided in articles 101B and 101C of the Constitution.
