Article 115: Interpretation of provisions relating to the public service
Chapter X - The Public Service

In this Constitution, unless the context otherwise requires, "public office" means an office of emolument in the public service.

For the purposes of this Constitution, a person shall not be considered to hold a public office by reason only that he is in receipt of a pension or other like allowance in respect of service under the Government of Malta or any former government of Malta.

If it is provided by any law that an office (not being an office constituted by this Constitution) shall not be a public office for the purposes of this Constitution, this Constitution shall have effect accordingly as if that provision of that law were a provision of this Constitution.
